Terms of Service

These terms are subject to change. We recommend reviewing them periodically.

1. Agreement to Terms

By accessing or using PostMimic — including the website at postmimic.app, the web portal at app.postmimic.app, the desktop application, or the API — you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the service.

You must be at least 18 years of age, or the age of majority in your jurisdiction, to use PostMimic.

If you are using PostMimic on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" refers to both you individually and the organization.

2. Description of Service

PostMimic is an AI-powered social media content generation and publishing platform. The service:

  • Analyzes user-provided posting history to create a voice profile that captures your unique writing style
  • Generates new social media content that matches your writing style, tone, vocabulary, and perspective
  • Publishes content to connected social media platforms, including X (Twitter), LinkedIn, Facebook Pages, and Instagram
  • Is available via the web portal at app.postmimic.app, a desktop application for Windows and macOS, and an API
  • Uses third-party AI providers — including DeepSeek, OpenAI, Anthropic, and xAI — to generate content

3. Accounts and Registration

An account is required to use PostMimic. When creating an account, you must provide a valid email address and accurate information. You are responsible for:

  • Maintaining the confidentiality of your password and account credentials
  • All activity that occurs under your account
  • Notifying us immediately at support@vibelabsmarketing.com if you suspect unauthorized access to your account

Accounts are for individual use only. Sharing account credentials with others is prohibited. We may suspend or terminate accounts that violate these Terms.

4. Subscription Plans and Billing

PostMimic offers the following plans:

  • Free: 5 AI-generated posts (one-time allocation), limited features
  • Starter ($19/month): Expanded post generation and features
  • Pro ($39/month): Full feature access including brand rules and content briefs
  • Agency ($149/month): Multi-profile support and advanced features for teams and agencies

Annual billing is available at a 17% discount. Users who provide their own AI API keys (BYOK) receive a $10/month discount.

All paid plans include a 3-day free trial. A valid credit card is required to start a trial. Billing is handled by Stripe, and by subscribing you agree to Stripe's Terms of Service.

Subscriptions auto-renew unless canceled before the renewal date. You may cancel at any time via your account settings (Stripe Customer Portal). No refunds are issued for partial billing periods.

We reserve the right to change pricing with at least 30 days' notice to existing subscribers.

5. AI-Generated Content and User Responsibility

All content generated by PostMimic is your responsibility. PostMimic is a tool that assists with content creation — it does not provide editorial judgment or guarantee the accuracy, appropriateness, or factual correctness of generated content.

  • You must review all AI-generated content before publishing
  • AI-generated content may contain errors, inaccuracies, or hallucinations
  • You are solely liable for any content you publish through the platform
  • Content generated via PostMimic may be subject to the usage policies of the underlying AI providers

6. AI Provider Usage Policies

PostMimic uses third-party AI providers to generate content. By using cloud AI generation, you agree to comply with the usage policies of the provider being used:

Users who provide their own API keys (BYOK) are directly bound by their agreement with the respective provider.

PostMimic may terminate accounts that violate AI provider usage policies.

7. Prohibited Uses

You may not use PostMimic to:

  • Generate or distribute content that violates any applicable law or regulation
  • Create content designed to deceive, manipulate, or impersonate others without consent
  • Produce content that targets, exploits, or endangers minors
  • Facilitate violence, terrorism, or illegal activities
  • Generate harassment, hate speech, or discriminatory content
  • Create spam or unsolicited bulk messages
  • Circumvent usage limits, metering, or access controls
  • Reverse engineer, decompile, or disassemble the software
  • Resell access to the platform without an Agency or Enterprise agreement
  • Use the platform to train competing AI models

8. Platform Connections and OAuth

PostMimic connects to third-party social media platforms — including X (Twitter), LinkedIn, Facebook, and Instagram — via OAuth authorization.

  • You authorize PostMimic to read your posting history (for voice training) and to publish content on your behalf
  • OAuth tokens are stored encrypted on our servers using Fernet symmetric encryption
  • You can revoke platform access at any time from your account settings or directly on the respective platform
  • PostMimic is not responsible for changes to third-party platform APIs, terms, or availability
  • Platform-specific limitations apply (for example, Facebook personal timeline posting is not available via API)

9. BYOK and Local AI

  • You may provide your own API keys for supported AI providers (BYOK mode). BYOK keys are stored encrypted on our servers and used only to make API calls on your behalf.
  • You are responsible for any API usage costs incurred when using BYOK. We are not responsible for costs incurred through BYOK API usage.
  • You may run AI models locally via Ollama. When using local AI, PostMimic does not access, store, or transmit any data processed locally.

10. Intellectual Property

  • PostMimic and its original content, features, and functionality are owned by Vibe Labs Digital.
  • Content generated using the platform belongs to the user who generated it.
  • Voice analysis data derived from your content is stored in your account and deleted upon account deletion.
  • You retain all rights to your original posting history used for voice training.

11. Data Handling and Deletion

Please refer to our Privacy Policy for full details on data collection and handling.

You may request account deletion at any time by contacting privacy@vibelabsmarketing.com or by using the account deletion feature in your settings.

Upon account deletion, we will delete your account information, voice analysis data, generated content history, stored OAuth tokens, API keys, and all profile data. Deletion is processed within 30 days of your request.

Some data may be retained as required by law or for legitimate business purposes, such as billing records for tax compliance.

12. Limitation of Liability

PostMimic is provided "as is" and "as available" without warranties of any kind, either express or implied.

  • We do not warrant that the service will be uninterrupted, error-free, or secure
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service
  • Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
  • We are not liable for any content published by users through the platform
  • We are not liable for any actions taken by third-party platforms in response to content published via PostMimic

13. Indemnification

You agree to indemnify, defend, and hold harmless Vibe Labs Digital, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from:

  • Content you generate, publish, or distribute using PostMimic
  • Your violation of these Terms or any applicable law
  • Your violation of AI provider usage policies
  • Your unauthorized use of third-party intellectual property

14. Account Termination

  • You may cancel your account at any time
  • We may suspend or terminate accounts for violations of these Terms with or without notice
  • We may terminate accounts that violate AI provider usage policies
  • Upon termination, your access to the service ceases immediately
  • You may request a copy of your data before termination

15. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email to registered users at least 30 days before taking effect.

Continued use of PostMimic after changes take effect constitutes acceptance of the updated Terms. If you disagree with updated Terms, you may cancel your account.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of PostMimic shall be resolved in the state or federal courts located in Bexar County, Texas. You waive any objection to jurisdiction and venue in these courts.
